Please read these terms before subscribing.

They apply to subscriptions arranged directly with Pex Publications Pty Ltd.

01 Introduction

These Terms and Conditions govern subscriptions to products supplied by Pex Publications Pty Ltd ("PEX", "we", "us" or "our"). A person or organisation purchasing, accessing or using a PEX product ("Subscriber", "you" or "your") agrees to these Terms.

By subscribing, you confirm that you are legally capable of entering a binding contract and, if purchasing for an organisation, are authorised to bind that organisation.

02 Subscription, billing and cancellation

Subscription enquiries are arranged directly with PEX by email, telephone or written correspondence. PEX will confirm the product, term, price, currency, delivery arrangements and payment instructions before an order is accepted.

The applicable subscription term and any renewal arrangement will be stated in the written confirmation, quote or invoice supplied by PEX. This website does not currently take a subscription payment or create an automatically renewing subscription.

You may request cancellation by contacting PEX. Any notice period, effect on a current term and future renewal will be handled according to the written subscription arrangement. Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

Prices are billed in Australian dollars and published website prices include GST for Australian customers. Customers outside Australia must contact PEX for current tax-exclusive pricing. Published prices and introductory offers may change before PEX accepts an order.

Access or delivery begins after PEX receives reliable confirmation of payment. Introductory offers are limited to eligible new subscribers and may have additional written conditions.

03 Subscription and rights of use

PEX grants the Subscriber a limited, non-exclusive and non-transferable licence to access and use the subscribed product internally within the purchasing organisation. Access is limited to authorised people in that organisation and must be for its internal business purposes.

A subscription does not transfer ownership of PEX or its intellectual property. The product is for the Subscriber’s benefit and must not be used for a third party unless PEX has approved that use in writing.

You must keep copyright and proprietary notices intact, protect login credentials and emailed files, and take reasonable steps to prevent unauthorised access. PEX may monitor product use to protect the service and confirm compliance with these Terms.

04 Prohibited distribution

You must not sub-license, sell, forward, publish, reproduce or otherwise provide any PEX product to an external person or entity without prior written permission.

This prohibition includes other companies, non-controlled subsidiaries or affiliates, contractors, consultants, associates, friends, family and any person who is not an employee or authorised member of the subscribing organisation.

Unauthorised distribution is a serious breach. PEX may suspend or terminate access and may pursue remedies available at law. A restriction may be waived only by prior written approval from an authorised PEX representative, and that approval may include additional conditions.

05 Intellectual property

All product content, features, logos, graphics, data compilations, software and the selection and arrangement of that material are owned by or licensed to PEX. All rights are reserved.

You may not reproduce, modify, create derivative works, distribute, perform, display, frame, scrape or otherwise exploit product content except to the limited extent expressly permitted by these Terms or approved in writing.

PEX and associated logos are trademarks of Pex Publications Pty Ltd. Other marks remain the property of their owners. Feedback supplied to PEX may be used to improve its products without an obligation to compensate the person providing it.

06 Changes, suspension and termination

PEX may update these Terms by publishing a revised version or communicating it to Subscribers. Material changes affecting an active subscription will apply according to its written arrangement unless required by law or agreed with you.

PEX may suspend or terminate access for a material breach, including non-payment, credential misuse or unauthorised distribution. If a provision is invalid or unenforceable, it will be adjusted only as necessary and the remaining provisions continue to apply.

07 Governing law and jurisdiction

These Terms are governed by Australian law. Subject to any mandatory consumer jurisdiction, disputes are to be resolved by courts located in Australia. A Subscriber outside Australia remains responsible for complying with local laws that apply to its use of the product.
